SHEARWATER ADVENTURES
General Terms and Conditions of Trade

Introduction
These General Terms and Conditions of Trade ("Terms") govern the relationship between Shearwater Adventures ("SWA") and any Reseller or Customer engaging SWA's services. Unless superseded by “activity-specific conditions” outlined herein or in separate agreements, the following provisions shall apply.

1. Prices
1.1. All prices are quoted in United States Dollars (USD).
1.2. All prices include Value Added Tax (VAT) and the Zimbabwean Government Tourism Levy where applicable.
1.3. All prices exclude National Park fees for activities where applicable.
1.4. National Parks usage and entry fees are subject to change. Resellers should verify current fees at the time of booking to provide accurate information to clients.
1.5. SWA reserves the right to amend prices without prior notice due to market conditions or other factors.

2. Payment
2.1. All payments shall be made in USD unless a special arrangement is made between the parties and confirmed in writing.
2.2. Full payment is required before the date of travel unless prior arrangements have been made.
2.3. Credit terms may be extended to the Reseller by separate agreement and at the discretion of SWA.

3. Taxes and Withholding
3.1. Prices will include VAT at the current standard rate where applicable.
3.2. Zimbabwean Resellers must provide their VAT Registration Number and Tax Clearance Certificate.
3.3. In accordance with tax regulations, SWA may deduct withholding tax from payments to Resellers. These withheld funds will be remitted to the Zimbabwe Revenue Authority (ZIMRA).

4. Bookings
4.1. All bookings shall be made with the SWA Central Reservations Office ("CRO") in Victoria Falls.
4.2. Confirm availability with SWA CRO prior to booking.
4.3. All clients must be in possession of a valid SWA travel voucher (hard copy or digital) and present it prior to embarking on any SWA activity.

5. Children, Young Adult and Age Restrictions Policy
5.1. Children may be entitled to discounts on certain SWA activities. Please refer to the Children's Discount Policy Table in Appendix B.
5.2. Age restrictions apply to specific activities. Please refer to the Activity-Specific Terms and Conditions in Appendix A.
5.3. Some activities have additional restrictions for children and young adults, such as weight or participation limitations. Please refer to the Activity-Specific Terms and Conditions in Appendix A.

6.0 General Cancellation Policy
6.1. In the event that the Reseller cancels their reservation for any reason, such cancellation must be made in writing (or if made telephonically, confirmed forthwith in writing). The Reseller shall be liable for SWA's cancellation charges as set out in the cancellation policy.
6.2. Amendments and all cancellations en-route must be made by the Reseller. The Reseller shall be liable for all costs, including but not limited to repatriation and administrative fees incurred by SWA as a result of any en-route cancellations by the Reseller, including cancellations due to ill health or injury.
6.3. Cancellation shall be effective only on the date which SWA receives the notification of cancellation.
6.4. Cancellations made within 24 hours of the scheduled activity, or failure to arrive (no-show), will result in a cancellation fee equal to 100% of the total price.

7.0 Cancellation of Service
7.1. All activities are subject to availability and may be affected by weather conditions, river levels, or other factors beyond SWA's control.
7.2. SWA reserves the right, at its sole discretion, to refuse to allow any of the Reseller's Resellers (whether an adult or child) to take part in any or all of SWA's tourist activities.
7.3. SWA reserves the right to cancel any activity due to unfavourable conditions, including but not limited to weather or safety concerns.

8.0 Travel Documents, Insurance, Vaccinations, Inoculations, and Re-entry Permits
8.1. All Resellers shall ensure that the traveller(s) are in possession of and have complied with:
(a) The correct travel documentation, including passports valid for the minimum period required by law in each country the
traveller will visit.
(b) The correct visas and re-entry permits, valid for the countries visited. Visa costs incurred are for the traveller’s own account.
(c) Health, foreign exchange, and other legal requirements.
8.2. The Reseller shall advise the traveller to take out comprehensive travel insurance and to familiarise themselves with any exceptions and conditions imposed by the insurance provider, SWA, or underwriters issuing the policy of insurance selected. SWA shall not be responsible or liable for any matters arising from the Reseller's failure to comply with this clause.

9.0 Resellers' Responsibility and Liability
9.1. The Reseller will inform their clients of all relevant information pertaining to activity requirements, including age and fitness restrictions, and shall be responsible for the collection of all money due from such clients and for payment to SWA.
9.2. The Reseller will inform their clients of any National Parks Fees or other additional charges that are payable and collected by SWA.


10.0 Variation of Terms and Conditions
10.1. No variation of these Terms and Conditions shall be binding unless communicated in writing by SWA.

11. Breach
11.1. Should any of these Terms and Conditions not be fully complied with, SWA reserves the right to:
(a) Cancel booking(s).
(b) Withdraw prices.
(c) Withdraw any other special trading arrangements.
(d) Take legal action as necessary.

12.0 Termination
12.1. SWA reserves the right to terminate this agreement by giving the Reseller one (1) months’ notice.

13.0 Legality
13.1. This Agreement is non-assignable and shall be construed and have effect in accordance with the laws of Zimbabwe.

14.0 Activity-Specific Terms and Conditions
14.1. Specific terms, conditions, age restrictions, and other limitations apply to individual activities offered by SWA. These activity-specific terms supersede the General Terms and Conditions where applicable. Please refer to Appendix A for detailed information.

Appendix A: Activity-Specific Terms and Conditions

1. White Water Rafting
• Minimum Age: 15 years.
• Fitness Requirements: Reasonable fitness is required.
• Inclusions: Transfers to/from Victoria Falls accommodation, all equipment, lunch, and drinks at the end of the trip.
• Availability: Subject to river water levels; may close in April/May if water levels are too high.
• Additional Fees: Clients are required to pay National Parks River Usage fees on/before check-in.
• Minimum Participants: 2 pax
• Notes: Multi-day rafting trips require a minimum of six (6) confirmed participants.
• Turnaround Time: 7 hours.

2. Adventure Jetboat
• Minimum Age: 10 years.
• Fitness Requirements: Reasonable fitness is required.
• Inclusions: Transfers to/from Victoria Falls accommodation.
• Availability: Subject to river water levels; may close if water levels are too low which is usually August to December.
• Additional Fees: Clients are required to pay National Parks River Usage fees on/before check-in.
• Minimum Participants: 2 pax
• Turnaround Time: 2 hrs (30 to 45 mins on boat).

3. Helicopter Scenic Flights
• Age Restrictions: Open to all ages.
• Children's Discount: Children below two (2) years of age fly for free but do not get a seat.
• Inclusions: Transfers to and from Victoria Falls accommodation.
• Conditions: Flights are subject to weather conditions and may be cancelled if unfavourable conditions prevail.
• Regulations: Governed by Civil Aviation Authority of Zimbabwe (CAAZ) regulations.
• Additional Fees: Clients are required to pay Government fees and Fuel Surcharge on/before check-in.
• Turnaround Time: 1 hour.

4. Bungee Jump
• Minimum Age: 14 years.
• Minimum Weight: 40 kg.
• Maximum Weight: 120kg
• Conditions:
o Activity may be interrupted by rain during the rainy season (November to February).
o Operating times normally commence at 9 AM. However, from March to June, when Victoria Falls is in full flood, operating
times start at 10 AM.
• Transfers: Transfers are not included in the rate but may be purchased separately.
• Passport Requirement: Clients must bring their passports to access the bridge. No visa fees apply if only visiting the bridge from
either Zimbabwe or Zambia.
• Turnaround Time: 1 hour.

5. Bridge Swing
• Minimum Age: 14 years.
• Minimum Weight: 40 kg.
• Maximum Weight: 180 kg.
• Conditions, Transfers and Passport Requirement: Same as Bungee Jump.
• Turnaround Time: 1 hour.

6. Bridge Slide
• Minimum Age: 8 years.
• Minimum Weight: 40 kg.
• Maximum Weight: 140 kg.
• Conditions, Transfers and Passport Requirement: Same as Bungee Jump.
• Turnaround Time: 1 hour.

7. Historical Bridge Tour
• Minimum Age: 10 years.
• Conditions, Transfers and Passport Requirement: Same as Bungee Jump.
• Turnaround Time: 2 hours.

8. Sunset Cruise
• Age Restrictions: Open to all ages.
• Children's Discount:
o Children under two (2) years of age cruise for free but will not be allocated a seat or provided with snacks. However, for an
additional fee, snacks will be provided.
o Children aged 3-11 years pay half price.
• Inclusions: Return transfers from Victoria Falls accommodation, snacks, and beverages.
• Minimum Participants: 2 pax
• Additional Fees: Clients are required to pay National Parks River Usage fees at the SWA CRO.
• Turnaround Time: 2 hours 30 mins.


9. Guided Tour of the Falls Tour
• Age Restrictions: Open to all ages.
• Children's Discount:
o Children under two (2) years of age tour for free
o Children aged 3-11 years pay half price.
• Inclusions: Return transfers from Victoria Falls accommodation.
• Additional Fees:
o Clients are required to pay National Parks fees on/before check-in
o Children under the age of six (6) and Zimbabwean residents aged 70 and above do not have to pay National Park fees.
• Turnaround Time: 2 hours.

10. Night Game Drive
• Minimum Age: 4 years.
• Children's Discount: Children aged 4-11 years pay half price.
• Inclusions: Return transfers, drinks, and a bush dinner under the stars (weather permitting).
• Additional Fees: Clients are required to pay National Parks fees on/before check-in
• Turnaround Time: 5 hours.

11. Game Drive(AM and PM)
• Minimum Age: 4 years.
• Children's Discount: Children aged 4-11 years pay half price.
• Inclusions: Return transfers, teas, coffees and muffins on morning trips, drink and light snacks for the afternoon trips.
• Additional Fees: Clients are required to pay National Parks fees on/before check-in
• Turnaround Time: 3 hours.

13. Walking Safari
• Minimum Age: 14 years.
• Fitness Requirements: Reasonable fitness is required.
• Inclusions: Return transfers, teas, coffees and muffins on morning walks.
• Turnaround Time: 2 hours.

14. Chobe Day Trip
• Minimum Age: 4 years.
• Children's Discount: Children under 12 years pay 75% of the adult price.
• Inclusions: Return transfers, lunch.
• Passport Requirement: Clients must bring their passports. Visa fees apply where applicable.
• Turnaround Time: Full day.

16. Livingstone Island Tour (Zambia)
• Minimum Age: 6 years.
• Restrictions for Children 6-11 Years: No swimming in the Devil’s pool.
• Passport Requirement: Clients must bring their passports. Visa fees apply where applicable.
• Turnaround Time: 2 hours.

17. Simunye Theatre Show
• Age Restrictions: Open to all ages.
• Check-in Time: Guests are required to check in at 7:45 PM.
• Late Arrival Policy:
o The performance is scheduled to commence promptly at 8:00 PM and will conclude at 9:00 PM.
o Latecomers will not be admitted once the show has commenced.
• Operating Days: The theatre is closed on Mondays.
• Children's Discount: Children aged 3-15 years pay half price.
• Inclusions: Meals and refreshments are not included, however an early dinner may be booked SWA CRO.
• Transfers: Transfers are not included in the rate but may be purchased separately.
• Turnaround Time: 1 hour and 30 mins.

18. Ele Crew
• Minimum Age: 3 years.
• Pickup Time: 0800hrs, 1030hrs and 1430hrs.
• Restrictions: No elephant walks for children 12 years and below.
• Children's Discount: Children aged 3-11 years pay half price.
• Inclusions: Return transfers, with light snacks
• Turnaround Time: 2 hours.

19. Traditional Village Tour
• Age Restrictions: Open to all ages.
• Children's Discount: Children aged 3-11 years pay half price.
• Minimum Participants: 2 pax
• Time Slots: Morning and Afternoon.
• Turnaround Time: 2 hours.

20. Explorers Village
• Cancellation Policy:
o A booking will be cancelled if payment is not received in full 30 days prior to the date of travel.
o A deposit of fifty percent (50%) of the total booking amount is required within seven (7) days of making the booking to
confirm the reservation.
o For reservations made within thirty (30) days prior to travel, the total price shall immediately be due and payable within
seventy-two (72) hours from the date of booking.
o Cancellation within 30 days prior to travel attracts 100% cancellation fee.
o Cancellation within 31-60 days prior to travel attracts 50% cancellation fee.
• Group Policy
o A group is defined as ten (10) or more paying rooms.
o For group bookings, booking status updates are required at 90, 60, and 45 days before the date of travel.
o The final rooming list and full payment is required 45 days prior to arrival to avoid automatic release of bookings.
• Children Discount Policy:
o Children up to 3 years - complimentary when accommodated with parent(s). This includes breakfast and excludes lunch
and dinner.
o Children 4 to 12 years sharing room with parent(s) are accommodated at a child supplement of 50% of the per person
sharing rate.
o Children 13 years and older are considered adults and are required to book their own room. An interleading room will be
provided if available.
o A room taken by child(ren) will be charged at 75% the adult rate.

Appendix B: Children's Discount Policy

Children must be accompanied by an adult at all times.
