Service Terms and Conditions

Shearwater Adventures - Terms and Conditions of trade:

1 PRICES
1.1 All prices are denominated in USD.
1.2 SHEARWATER reserve the right to change prices without notice.

2 PAYMENT
2.1 All payments are to be made in USD unless a special arrangement is made between the parties and committed to writing.
2.2 All payments are required in full before booking is confirmed.
2.3 Invoice will be cancelled if payment is not received in full 30 days prior to the date of travel.
2.4 Credit terms will be extended to the Reseller by separate agreement and at the discretion of SWA.
2.5 A 50% deposit is required within 7 days of receipt of invoice to confirm a booking.
2.6 In the event of any reservation made within 30 (thirty) days prior to departure, the total price shall be immediately due (72 hours) after receipt of invoice and payable on confirmation and the services reserved are subject to availability and are not guaranteed. Cancellation terms apply on confirmation as per clause below.

3 TAX & VAT
3.1 Prices will, if applicable, include VAT at the current standard rate.
3.2 In accordance with tax regulations, Shearwater may deduct withholding tax from payments to resellers. These withheld funds will be remitted to the Zimbabwe Revenue Authority (ZIMRA).

4 BOOKINGS
4.1 All bookings will be made with the Shearwater Central Reservations Office (CRO) in Victoria Falls.
4.2 All clients must be in possession of a valid travel voucher and will need to present this prior to embarking on any Shearwater activity.

5 CHILDREN
5.1 On some Shearwater activities children are entitled to a discount. Please refer to the children policy
5.2 Some Shearwater activities have age restrictions, please confirm this when booking with the CRO.

6 GROUP POLICY
6.1 A group is described as 10+ pax travelling together.
6.2 For group bookings, booking status is required at 90, 60 and 45 days before date of travel.
6.3 Rooming list is required 45 days before date of travel.
6.4 Group bookings, final numbers and final rooming list is required 45 days before date of travel.

7 CANCELLATION POLICY
7.1 In the event of the customer cancelling their reservation for any reason, such cancellation must be made in writing (or if made telephonically, confirmed forthwith in writing), in which event the customer shall be liable for SWA’s cancellation charges as set out in cancellation policy.
7.2 Amendments and all cancellations en-route must be made by the customer. The customer shall be liable for all costs (including repatriation and the administrative fees which SWA incurs) as a result of any en-route cancellations by the customer including but not limited to cancellation because of ill health or injury.
7.3 Cancellation shall be effective only on the date which SWA receives the notification of cancellation.

8 SWA ACTIVITIES GENERAL CANCELLATION POLICY
8.1 Cancellation more than 30 days before date of travel - no charge.
8.2 Cancellation within 24 hrs - 50% cancellation fees.
8.3 No show - 100% cancellation fees.

9 SW EV GENERAL CANCELLATION POLICY
9.1 Cancellations received within 0 - 30 days prior to travel (FITs) attract 100% cancellation fee.
9.2 Cancellations received within 30 - 45 days prior to travel (FITs) attracts 50% cancellation fee.
9.3 Cancellations received within 0 - 45 days prior to travel (Groups) attract 100% cancellation fee.
9.4 Cancellations received within 45 - 60 days prior to travel (Groups) attract 50% cancellation fee.
9.5 All no shows attract a 100% cancellation fee.

10 TRAVEL DOCUMENTS, INSURANCE, VACCINATIONS, INOCULATIONS AND RE-ENTRY PERMITS
10.1 All resellers shall ensure that the traveler/s are in the possession of and have complied with:
i) the correct travel documentation, including passports valid for the minimum period after the tour, required by law in each country the traveler will visit.
ii) the correct visas/re-entry permits, valid for the country visited - the visa costs incurred are for the traveler’s
own account; and
iii) health, foreign exchange and other legal requirements.
10.2 The customer shall advise the traveler to take out comprehensive travel insurance and to familiarize themselves with any exceptions and conditions as may be imposed by the insurance, SWA or underwriters issuing the policy of insurance, which they select. SWA shall not be responsible or liable.

11 REJECTION
11.1 SWA reserves the right to refuse, at its own discretion, to allow any of the Reseller’s customers (whether an
adult or child) to take part in any or all SWA’s tourist activities.

12 TOUR OPERATORS' RESPONSIBILITY & LIABILITY
12.1 The Reseller will inform their clients of all relevant information pertaining to activity requirements and shall be responsible for collection of all money due from such clients and for payment to Shearwater.
12.2 The reseller will inform their clients of any National Parks Fees that are payable and collected by Shearwater.

13 VARIATION OF TERMS & CONDITIONS
13.1 No variation of these terms and conditions shall be binding unless communicated in writing by Shearwater

14 BREACH
14.1 Should ANY of these terms and conditions itemized above not be fully complied with, Shearwater reserves the right to:
i) Cancel reservations.
ii) Withdraw prices.
iii) Withdraw any other special trading arrangements.
iv) Terminate the contract.
v) Take legal action as necessary.

15 TERMINATION
15.1 Shearwater reserves the right to terminate this agreement by giving the agent one months' notice.

16 LEGALITY
16.1 This agreement is non-assignable and shall be constructed and have effect according to the laws of Zimbabwe.
